Welcome to Marvio Digital. By accessing our website marviodigital.com or engaging with our services, you agree to the following Terms & Conditions. These Terms are a legally binding agreement between you (“Client”, “User”, “you”) and Marvio Digital (“we”, “our”, “us”).

1. Use of Website

You agree to use this website in a lawful and respectful manner. You may not:

  • Copy, scrape, or reuse any content without written permission
  • Attempt to access protected areas or use our site to distribute malware
  • Misrepresent your identity or submit false inquiries

We reserve the right to suspend access or take legal action in cases of abuse or fraud.

2. Scope of Services

Marvio Digital offers services including but not limited to:

  • Web design and development
  • WordPress theme and plugin customization
  • Hosting and domain setup assistance
  • Digital marketing consultation
  • Website maintenance and troubleshooting

A detailed service scope will be agreed upon before the start of any project. Services outside the original scope will be subject to additional charges.

3. Payments & Renewals
3.1. Standard Payment Terms
  • A minimum of 50% upfront payment is required to begin all projects. This upfront payment is non-refundable as it secures your project in our schedule and covers time invested in early planning, design, and setup.
  • The remaining balance is due upon final delivery or before going live
  • Accepted payment methods and deadlines will be outlined in the invoice or proposal
3.2. Hosting & Domain Renewals

We assist in managing third-party services such as web hosting and domain registration. These are billed separately, and clients are responsible for renewing them on time.

⚠️ Important: If you fail to pay renewal fees on or before the deadline we provide, your website may go offline automatically. These services are managed by third-party providers, and Marvio Digital holds no responsibility for downtime, loss of access, or data loss due to missed payments.

We always provide advance notice before renewals.

In cases where clients are unable or unwilling to settle their renewal fees by the deadline, we can provide a full backup of the website files and database upon request. After this point, Marvio Digital will not be held responsible for storing or maintaining the website.

Should the client later wish to bring the website back online, we can assist in re-setup and deployment. However, please note that we cannot guarantee the availability of the previously used domain, as expired domains may become available to the public and be purchased by other entities.

Any work required to restore and redeploy the website will be billed at our standard hourly rate, as outlined in Section 5.1.

4. Ownership & Intellectual Property

Unless otherwise agreed:

  • All code, design, and content developed by Marvio Digital becomes the property of the client upon full payment.
  • We may retain a non-exclusive right to showcase the project in our portfolio or marketing materials.
  • Any third-party tools (plugins, fonts, stock images) are subject to their own licensing terms and may require renewal or extended license fees.
5. Post-Launch Support

Each completed project includes 6 months of free support, which covers:

  • Bug fixes and performance adjustments
  • Minor design tweaks
  • General assistance related to the delivered work

❌ This free period does NOT include:

  • Adding new pages or features
  • Major design overhauls
  • SEO work, content writing, or digital marketing
  • Plugin/theme updates requiring extensive modification
5.1. Paid Maintenance

After the 6-month period, continued support will be billed per hour. Our standard hourly rate will be communicated before starting any paid support.

💱 Note: Hourly rates may change due to currency fluctuations, platform/tool costs, or project complexity.

We will always provide an estimate before beginning chargeable work.

6. Project Timeline & Client Responsibilities
  • Project timelines are estimated and may vary depending on feedback, content delays, or revisions requested by the client.
  • Clients are expected to provide required materials (text, images, login info, etc.) on time.
  • Inactive projects without client response for 30+ days may be placed on hold or archived. Re-activation may incur a reinitiation fee.
7. Refunds & Cancellations
  • Initial deposits are non-refundable once the work has commenced.
  • If a client chooses to cancel the project mid-way, the amount of work completed will be calculated and charged accordingly.
8. Limitation of Liability

Marvio Digital is not liable for:

  • Loss of data due to third-party hosting failure
  • Performance issues caused by third-party plugins or tools
  • Downtime due to unpaid renewals, malware attacks, or DNS issues
  • Losses from SEO drops, missed leads, or site bugs post-delivery

Our total liability, under any claim, shall not exceed the total amount paid to us for the project.

9. Third-Party Services & Integrations

We may integrate third-party tools and services (e.g. Stripe, Google Analytics, SMTP, SEO tools) into your project. These are governed by their own terms and privacy policies.

We are not responsible for the functionality, security, or continued availability of third-party services after delivery.

10. Portfolio Rights

We reserve the right to:

  • Display completed projects on our website and social media
  • Include your logo, screenshots, or case study (non-confidential only)

Let us know in writing if you’d like to opt-out of this.

11. Termination

We reserve the right to refuse service or terminate a client relationship if:

  • Abuse, harassment, or illegal behavior is exhibited
  • Repeated late payments or breach of these terms occurs

In such cases, any outstanding payments remain due.

12. Governing Law

These Terms shall be governed and interpreted under the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes arising will be subject to the jurisdiction of courts located in Galle, Sri Lanka.
